I mean, the post Robert Harvey was banned over represented a seeming intentional misreading of the intent of the CoC update: The whole "Be adults. You know what that means." ethos was the core of the previous version of the CoC.
But people acted, sometimes in ignorance, sometimes in bad faith, in ways that violated the spirit of "Be nice." and so the admins felt they needed to spell some important details out clearly.
Suggesting we should go back to the BSD license equivalent of the CoC is acting blind to actual behavior of users and moderators in even recent times.
